This page informs you of the Terms and Conditions on which we supply the goods ("Goods") listed on this website.

Marmadukes Antiques Terms and Conditions of Sale

Please read these terms and conditions carefully before ordering any Goods from our website. You should understand that by ordering any of our Goods, you agree to be bound by these terms and conditions.

• 1 How the Contract is formed between You and Us

• 1.1 After placing an order, you will receive an E mail from us acknowledging receipt of your order. This does not mean that your order has been accepted. Your order constitutes an offer to us to buy Goods. All orders are subject to acceptance by us, and we will acknowledge such acceptance by sending you a further E mail confirming that we have accepted your order (the "Acceptance"). This confirms the Goods are available for purchase. The contract between us ("Contract") will only be formed when we send you the Acceptance.

• 1.2 The Contract will relate only to those Goods confirmed in the Acceptance. We will not be obliged to supply any other Goods which may have been part of your order.

• 2 Consumer Rights

• 2.1 These terms and conditions only apply if you are dealing with us as a consumer.

• 2.2 Where you are contracting as a consumer, you may cancel the Contract within seven days, beginning on the day after you received the Goods. In this case, you will be refunded for the price you have paid for the Goods in accordance with the Marmadukes Guarantee and the Refunds Policy (Clause 7 of these Terms of Trading).

• 2.3 To cancel a Contract, you must inform us by E mail to antiques@marmadukes.freeserve.co.uk You must also return the Goods to us in the same condition as they were received. You have a legal obligation to take reasonable care of the Goods while they are in your possession.

• 3 Description and Representation

• 3.1 We try to show and describe Goods on this website as accurately as possible. Despite this, slight variations may occur. For example, the colour of some Goods may vary in accordance with the settings of your computer monitor or printer from the true colour of the Goods in reality.

• 3.2 All dimensions and sizes of Goods (where applicable) are given in good faith and are as accurate as possible under the circumstances.

• 4 Delivery and Availability

• 4.1 Delivery will be made to the address specified when you complete the order.

• 4.2 We use a variety of delivery methods depending on the size of Goods you order. Please read our Delivery section for more information about our deliveries

• 4.3 We aim to fulfil your order by any delivery date agreed or set out in our Acceptance or, if no delivery date is specified, then within a reasonable amount of time, unless there are circumstances beyond our control which prevent us from doing so. We shall contact you if we are having problems getting Goods to you by the arranged delivery date.

• 4.4 It is your responsibility to ensure that the Goods you have ordered will fit into your home. You should check the dimensions of the space within which the Goods will be placed.

• 4.5 A responsible adult must be available at the delivery address to inspect the Goods and sign and acknowledge their receipt in a safe and satisfactory condition. Any problems must be reported immediately on 01902 337 968.

• 5 Risk and Title

• 5.1 The Goods will be at your risk from the time of delivery.

• 5.2 Ownership of the Goods will only pass to you when we have received full payment of all sums due in respect of the Goods.

• 6 Price and Payment

• 6.1 All prices shown are fixed until further notice.

• 6.2 The prices of the Goods shown on this website do not include delivery costs. Under certain criteria delivery charges apply. The criterion pertaining to deliveries is set out in the Delivery section of this website. If delivery costs are applicable, then these should be added to the total Goods price and form part of the Contract.

• 6.3 Prices are liable to change at any time. However, charges will not affect Accepted orders.

• 6.4 However unlikely and despite our best efforts, it is always possible that Goods listed on our website may be incorrectly priced. If this is found to be the case, we will notify you, at our discretion, of the revised price. This applies to prices that are less than the stated price on our website, and also applies to any prices that are higher than those stated on our website. We reserve the right to reject your order and notify you of such rejection. We are under no obligation to provide the Goods to you at the incorrect lower price. Each situation will be evaluated at the time and, as previously mentioned, we will use our discretion should such an incident ever occur.

• 6.5 Payment for Goods can be made by cash, cheques or BACS transfer to us. Also debit and credit cards via our PayPal® shopping facility.

• 6.6 Payment for the Goods (and delivery charges where applicable) shall be due at the date of order.

• 7 Refunds Policy

• 7.1 If you return Goods to us because you have cancelled the Contract within the seven day period, we will process the refund due to you as soon as possible, and in any case, within 30 days of the day you gave us notice of your cancellation. In such a case, we will refund the price of the Goods in total. However, you will be responsible for the cost of returning the Goods to us or us collecting the Goods from you.

• 7.2 Goods cannot be returned to us because they are "unsuitable" after the seven day period, unless we agree. If we agree that Goods may be returned, then they must be returned in a condition equal to that of the condition the condition we delivered them in. We reserve the right to charge you any costs we incur directly resulting from the cancellation. Such costs shall not exceed 25% of the value of the Goods plus any delivery and return costs.

• 7.3 If you believe any of the Goods to be in an unacceptable condition, please contact us immediately by telephone or E mail to antiques@marmadukes.freeserve.co.uk. Please also E mail us photographs of any alleged defects to enable us to assess the situation.
